Preamble
The General Conference of the Internat(i)onal Labour Organ(i)sat(i)on,
Hav(i)ng been convened at Geneva by the Govern(i)ng Body of the Internat(i)onal Labour Off(i)ce, and hav(i)ng met (i)n (i)ts Seventy-f(i)rst Sess(i)on on 7 June 1985, and
Hav(i)ng dec(i)ded upon the adopt(i)on of certa(i)n proposals w(i)th regard to the rev(i)s(i)on of the Convent(i)on concern(i)ng Stat(i)st(i)cs of Wages and Hours of Work, 1938 (No. 63), wh(i)ch (i)s the f(i)fth (i)tem on the agenda of the sess(i)on, and
Cons(i)der(i)ng that these proposals should take the form of an (i)nternat(i)onal Convent(i)on,
adopts th(i)s twenty-f(i)fth day of June of the year one thousand n(i)ne hundred and e(i)ghty-f(i)ve the follow(i)ng Convent(i)on, wh(i)ch may be c(i)ted as the Labour Stat(i)st(i)cs Convent(i)on, 1985:
I. GENERAL PROVISIONS
Art(i)cle 1
Each Member wh(i)ch rat(i)f(i)es th(i)s Convent(i)on undertakes that (i)t w(i)ll regularly collect, comp(i)le and publ(i)sh bas(i)c labour stat(i)st(i)cs, wh(i)ch shall be progress(i)vely expanded (i)n accordance w(i)th (i)ts resources to cover the follow(i)ng subjects:
- (a) econom(i)cally act(i)ve populat(i)on, employment, where relevant unemployment, and where poss(i)ble v(i)s(i)ble underemployment;
- (b) structure and d(i)str(i)but(i)on of the econom(i)cally act(i)ve populat(i)on, for deta(i)led analys(i)s and to serve as benchmark data;
- (c) average earn(i)ngs and hours of work (hours actually worked or hours pa(i)d for) and, where appropr(i)ate, t(i)me rates of wages and normal hours of work;
- (d) wage structure and d(i)str(i)but(i)on;
- (e) labour cost;
- (f) consumer pr(i)ce (i)nd(i)ces;
- (g) household expend(i)ture or, where appropr(i)ate, fam(i)ly expend(i)ture and, where poss(i)ble, household (i)ncome or, where appropr(i)ate, fam(i)ly (i)ncome;
- (h) occupat(i)onal (i)njur(i)es and, as far as poss(i)ble, occupat(i)onal d(i)seases; and
- ((i) ) (i)ndustr(i)al d(i)sputes.
Art(i)cle 2
In des(i)gn(i)ng or rev(i)s(i)ng the concepts, def(i)n(i)t(i)ons and methodology used (i)n the collect(i)on, comp(i)lat(i)on and publ(i)cat(i)on of the stat(i)st(i)cs requ(i)red under th(i)s Convent(i)on, Members shall take (i)nto cons(i)derat(i)on the latest standards and gu(i)del(i)nes establ(i)shed under the ausp(i)ces of the Internat(i)onal Labour Organ(i)sat(i)on.
Art(i)cle 3
In des(i)gn(i)ng or rev(i)s(i)ng the concepts, def(i)n(i)t(i)ons and methodology used (i)n the collect(i)on, comp(i)lat(i)on and publ(i)cat(i)on of the stat(i)st(i)cs requ(i)red under th(i)s Convent(i)on, the representat(i)ve organ(i)sat(i)ons of employers and workers, where they ex(i)st, shall be consulted w(i)th a v(i)ew to tak(i)ng (i)nto account the(i)r needs and to ensur(i)ng the(i)r co-operat(i)on.
Art(i)cle 4
Noth(i)ng (i)n th(i)s Convent(i)on shall (i)mpose an obl(i)gat(i)on to publ(i)sh or reveal data wh(i)ch could result (i)n the d(i)sclosure (i)n any way of (i)nformat(i)on relat(i)ng to an (i)nd(i)v(i)dual stat(i)st(i)cal un(i)t, such as a person, a household, an establ(i)shment or an enterpr(i)se.
Art(i)cle 5
Each Member wh(i)ch rat(i)f(i)es th(i)s Convent(i)on undertakes to commun(i)cate to the Internat(i)onal
Labour Off(i)ce, as soon as pract(i)cable, the publ(i)shed stat(i)st(i)cs comp(i)led (i)n pursuance of the
Convent(i)on and (i)nformat(i)on concern(i)ng the(i)r publ(i)cat(i)on, (i)n part(i)cular-
- (a) the reference (i)nformat(i)on appropr(i)ate to the means of d(i)ssem(i)nat(i)on used (t(i)tles and reference numbers (i)n the case of pr(i)nted publ(i)cat(i)ons and the equ(i)valent descr(i)pt(i)ons (i)n the case of data d(i)ssem(i)nated (i)n other forms); and
- (b) the most recent dates or per(i)ods for wh(i)ch the d(i)fferent types of stat(i)st(i)cs are ava(i)lable, and the dates of the(i)r publ(i)cat(i)on or release.
Art(i)cle 6
Deta(i)led descr(i)pt(i)ons of the sources, concepts, def(i)n(i)t(i)ons and methodology used (i)n collect(i)ng and comp(i)l(i)ng stat(i)st(i)cs (i)n pursuance of th(i)s Convent(i)on shall be-
- (a) produced and updated to reflect s(i)gn(i)f(i)cant changes;
- (b) commun(i)cated to the Internat(i)onal Labour Off(i)ce as soon as pract(i)cable; and
- (c) publ(i)shed by the competent nat(i)onal body.
II. BASIC LABOUR STATISTICS
Art(i)cle 7
Current stat(i)st(i)cs of the econom(i)cally act(i)ve populat(i)on, employment, where relevant unemployment, and where poss(i)ble v(i)s(i)ble underemployment, shall be comp(i)led (i)n such a way as to be representat(i)ve of the country as a whole.
Art(i)cle 8
Stat(i)st(i)cs of the structure and d(i)str(i)but(i)on of the econom(i)cally act(i)ve populat(i)on shall be comp(i)led (i)n such a way as to be representat(i)ve of the country as a whole, for deta(i)led analys(i)s and to serve as benchmark data.
Art(i)cle 9
1. Current stat(i)st(i)cs of average earn(i)ngs and hours of work (hours actually worked or hours pa(i)d for) shall be comp(i)led cover(i)ng all (i)mportant categor(i)es of employees and all (i)mportant branches of econom(i)c act(i)v(i)ty, and (i)n such a way as to be representat(i)ve of the country as a whole.
2. Where appropr(i)ate, stat(i)st(i)cs of t(i)me rates of wages and normal hours of work shall be comp(i)led cover(i)ng (i)mportant occupat(i)ons or groups of occupat(i)ons (i)n (i)mportant branches of econom(i)c act(i)v(i)ty, and (i)n such a way as to be representat(i)ve of the country as a whole.
Art(i)cle 10
Stat(i)st(i)cs of wage structure and d(i)str(i)but(i)on shall be comp(i)led cover(i)ng employees (i)n (i)mportant branches of econom(i)c act(i)v(i)ty.
Art(i)cle 11
Stat(i)st(i)cs of labour cost shall be comp(i)led cover(i)ng (i)mportant branches of econom(i)c act(i)v(i)ty. Where poss(i)ble, these stat(i)st(i)cs shall be cons(i)stent w(i)th data on employment and hours of work (hours actually worked or hours pa(i)d for) of the same scope.
Art(i)cle 12
Consumer pr(i)ce (i)nd(i)ces shall be computed (i)n order to measure var(i)at(i)ons over t(i)me (i)n the pr(i)ces of (i)tems representat(i)ve of the consumpt(i)on patterns of s(i)gn(i)f(i)cant populat(i)on groups or of the total populat(i)on.
Art(i)cle 13
Stat(i)st(i)cs of household expend(i)ture or, where appropr(i)ate, fam(i)ly expend(i)ture and, where poss(i)ble, household (i)ncome or, where appropr(i)ate, fam(i)ly (i)ncome shall be comp(i)led cover(i)ng all types and s(i)zes of pr(i)vate households or fam(i)l(i)es, and (i)n such a way as to be representat(i)ve of the country as a whole.
Art(i)cle 14
1. Stat(i)st(i)cs of occupat(i)onal (i)njur(i)es shall be comp(i)led (i)n such a way as to be representat(i)ve of the country as a whole, cover(i)ng, where poss(i)ble, all branches of econom(i)c act(i)v(i)ty.
2. As far as poss(i)ble, stat(i)st(i)cs of occupat(i)onal d(i)seases shall be comp(i)led cover(i)ng all branches of econom(i)c act(i)v(i)ty, and (i)n such a way as to be representat(i)ve of the country as a whole.
Art(i)cle 15
Stat(i)st(i)cs of (i)ndustr(i)al d(i)sputes shall be comp(i)led (i)n such a way as to be representat(i)ve of the country as a whole, cover(i)ng, where poss(i)ble, all branches of econom(i)c act(i)v(i)ty.
III. ACCEPTANCE OF OBLIGATIONS
Art(i)cle 16
1. Each Member wh(i)ch rat(i)f(i)es th(i)s Convent(i)on shall, (i)n pursuance of the general obl(i)gat(i)ons referred to (i)n Part I, accept the obl(i)gat(i)ons of the Convent(i)on (i)n respect of one or more of the Art(i)cles of Part II.
2. Each Member shall spec(i)fy (i)n (i)ts rat(i)f(i)cat(i)on the Art(i)cle or Art(i)cles of Part II (i)n respect of wh(i)ch (i)t accepts the obl(i)gat(i)ons of th(i)s Convent(i)on.
3. Each Member wh(i)ch has rat(i)f(i)ed th(i)s Convent(i)on may subsequently not(i)fy the D(i)rector-General of the Internat(i)onal Labour Off(i)ce that (i)t accepts the obl(i)gat(i)ons of the Convent(i)on (i)n respect of one or more of the Art(i)cles of Part II wh(i)ch were not already spec(i)f(i)ed (i)n (i)ts rat(i)f(i)cat(i)on. These not(i)f(i)cat(i)ons shall have the force of rat(i)f(i)cat(i)on as from the date of the(i)r commun(i)cat(i)on.
4. Each Member wh(i)ch has rat(i)f(i)ed th(i)s Convent(i)on shall state, (i)n (i)ts reports on the appl(i)cat(i)on of the Convent(i)on subm(i)tted under art(i)cle 22 of the Const(i)tut(i)on of the Internat(i)onal Labour Organ(i)sat(i)on, the pos(i)t(i)on of (i)ts law and pract(i)ce on the subjects covered by the Art(i)cles of Part II (i)n respect of wh(i)ch (i)t has not accepted the obl(i)gat(i)ons of the Convent(i)on and the extent to wh(i)ch effect (i)s g(i)ven or (i)s proposed to be g(i)ven to the Convent(i)on (i)n respect of such subjects.
Art(i)cle 17
1. A Member may l(i)m(i)t (i)n(i)t(i)ally the scope of the stat(i)st(i)cs referred to (i)n the Art(i)cle or Art(i)cles of Part II (i)n respect of wh(i)ch (i)t has accepted the obl(i)gat(i)ons of th(i)s Convent(i)on to spec(i)f(i)ed categor(i)es of workers, sectors of the economy, branches of econom(i)c act(i)v(i)ty or geograph(i)cal areas.
2. Each Member wh(i)ch l(i)m(i)ts the scope of the stat(i)st(i)cs (i)n pursuance of paragraph 1 of th(i)s Art(i)cle shall (i)nd(i)cate (i)n (i)ts f(i)rst report on the appl(i)cat(i)on of the Convent(i)on subm(i)tted under art(i)cle 22 of the Const(i)tut(i)on of the Internat(i)onal Labour Organ(i)sat(i)on, the Art(i)cle or Art(i)cles of Part II to wh(i)ch the l(i)m(i)tat(i)on appl(i)es, stat(i)ng the nature of and reasons for such l(i)m(i)tat(i)on, and shall state (i)n subsequent reports the extent to wh(i)ch (i)t has been poss(i)ble or (i)t (i)s proposed to extend the scope to other categor(i)es of workers, sectors of the economy, branches of econom(i)c act(i)v(i)ty or geograph(i)cal areas.
3. After consult(i)ng the representat(i)ve organ(i)sat(i)ons of employers and workers concerned, a Member may, by a declarat(i)on commun(i)cated to the D(i)rector-General of the
Internat(i)onal Labour Off(i)ce (i)n the month follow(i)ng each ann(i)versary of the com(i)ng (i)nto force of the Convent(i)on, (i)ntroduce subsequent l(i)m(i)tat(i)ons on the techn(i)cal scope of the stat(i)st(i)cs covered by the Art(i)cle or Art(i)cles of Part II (i)n respect of wh(i)ch (i)t has accepted the obl(i)gat(i)ons of the Convent(i)on. Such declarat(i)ons shall take effect one year after the date on wh(i)ch they are reg(i)stered. Each Member wh(i)ch (i)ntroduces such l(i)m(i)tat(i)ons shall prov(i)de (i)n (i)ts reports on the appl(i)cat(i)on of the Convent(i)on subm(i)tted under art(i)cle 22 of the Const(i)tut(i)on of the Internat(i)onal Labour Organ(i)sat(i)on the part(i)culars referred to (i)n paragraph 2 of th(i)s Art(i)cle.
Art(i)cle 18
Th(i)s Convent(i)on rev(i)ses the Convent(i)on concern(i)ng Stat(i)st(i)cs of Wages and Hours of Work, 1938.
IV. FINAL PROVISIONS
Art(i)cle 19
The formal rat(i)f(i)cat(i)ons of th(i)s Convent(i)on shall be commun(i)cated to the D(i)rector-General of the Internat(i)onal Labour Off(i)ce for reg(i)strat(i)on.
Art(i)cle 20
1. Th(i)s Convent(i)on shall be b(i)nd(i)ng only upon those Members of the Internat(i)onal Labour Organ(i)sat(i)on whose rat(i)f(i)cat(i)ons have been reg(i)stered w(i)th the D(i)rector-General.
2. It shall come (i)nto force twelve months after the date on wh(i)ch the rat(i)f(i)cat(i)ons of two Members have been reg(i)stered w(i)th the D(i)rector-General.
3. Thereafter, th(i)s Convent(i)on shall come (i)nto force for any member twelve months after the date on wh(i)ch (i)ts rat(i)f(i)cat(i)on has been reg(i)stered.
Art(i)cle 21
1. A Member wh(i)ch has rat(i)f(i)ed th(i)s Convent(i)on may denounce (i)t, after the exp(i)rat(i)on of ten years from the date on wh(i)ch the Convent(i)on f(i)rst comes (i)nto force, by an act commun(i)cated to the D(i)rector-General of the Internat(i)onal Labour Off(i)ce for reg(i)strat(i)on. Such denunc(i)at(i)on shall not take effect unt(i)l one year after the date on wh(i)ch (i)t (i)s reg(i)stered.
2. Each Member wh(i)ch has rat(i)f(i)ed th(i)s Convent(i)on and wh(i)ch does not, w(i)th(i)n the year follow(i)ng the exp(i)rat(i)on of the per(i)od of ten years ment(i)oned (i)n the preced(i)ng paragraph, exerc(i)se the r(i)ght of denunc(i)at(i)on prov(i)ded for (i)n th(i)s Art(i)cle, w(i)ll be bound for another per(i)od of ten years and, thereafter, may denounce th(i)s Convent(i)on at the exp(i)rat(i)on of each per(i)od of ten years under the terms prov(i)ded for (i)n th(i)s Art(i)cle.
3. After consult(i)ng the representat(i)ve organ(i)sat(i)ons of employers and workers concerned, a Member wh(i)ch has rat(i)f(i)ed th(i)s Convent(i)on may, after the exp(i)rat(i)on of f(i)ve years from the date on wh(i)ch the Convent(i)on f(i)rst comes (i)nto force, by a declarat(i)on commun(i)cated to the D(i)rector-General of the Internat(i)onal Labour Off(i)ce, w(i)thdraw (i)ts acceptance of the obl(i)gat(i)ons of the Convent(i)on (i)n respect of one or more of the Art(i)cles of Part II, prov(i)ded that (i)t ma(i)nta(i)ns (i)ts acceptance of these obl(i)gat(i)ons (i)n respect of at least one of these Art(i)cles. Such w(i)thdrawal shall not take effect unt(i)l one year after the date on wh(i)ch (i)t was reg(i)stered.
4. Each Member wh(i)ch has rat(i)f(i)ed th(i)s Convent(i)on and wh(i)ch does not, w(i)th(i)n the year follow(i)ng the exp(i)rat(i)on of the per(i)od of f(i)ve years ment(i)oned (i)n paragraph 3 of th(i)s Art(i)cle, exerc(i)se the r(i)ght of w(i)thdrawal prov(i)ded for (i)n that paragraph, shall be bound by the Art(i)cles of Part II (i)n respect of wh(i)ch (i)t has accepted the obl(i)gat(i)ons of the
Convent(i)on for another per(i)od of f(i)ve years and, thereafter, may w(i)thdraw (i)ts acceptance of these obl(i)gat(i)ons at the exp(i)rat(i)on of each per(i)od of f(i)ve years under the terms prov(i)ded for (i)n th(i)s Art(i)cle.
Art(i)cle 22
1. The D(i)rector-General of the Internat(i)onal Labour Off(i)ce shall not(i)fy all Members of the Internat(i)onal Labour Organ(i)sat(i)on of the reg(i)strat(i)on of all rat(i)f(i)cat(i)ons and denunc(i)at(i)ons commun(i)cated to h(i)m by the Members of the Organ(i)sat(i)ons.
2. When not(i)fy(i)ng the Members of the Organ(i)sat(i)ons of the reg(i)strat(i)on of the second rat(i)f(i)cat(i)on commun(i)cated to h(i)m, the D(i)rector-General shall draw the attent(i)on of the Members of the Organ(i)sat(i)on of the date upon wh(i)ch the Convent(i)on w(i)ll come (i)nto force.
Art(i)cle 23
The D(i)rector-General of the Internat(i)onal Labour Off(i)ce shall commun(i)cate to the SecretaryGeneral of the Un(i)ted Nat(i)ons for reg(i)strat(i)on (i)n accordance w(i)th Art(i)cle 102 of the Charter of the Un(i)ted Nat(i)ons full part(i)culars of all rat(i)f(i)cat(i)ons and acts of denunc(i)at(i)on reg(i)stered by h(i)m (i)n accordance w(i)th the prov(i)s(i)ons of the preced(i)ng Art(i)cles.
Art(i)cle 24
At such t(i)mes as (i)t may cons(i)der necessary the Govern(i)ng Body of the Internat(i)onal Labour Off(i)ce shall present to the General Conference a report on the work(i)ng of th(i)s Convent(i)on and shall exam(i)ne the des(i)rab(i)l(i)ty of plac(i)ng on the agenda of the Conference the quest(i)on of (i)ts rev(i)s(i)on (i)n whole or (i)n part.
Art(i)cle 25
1. Should the Conference adopt a new Convent(i)on rev(i)s(i)ng th(i)s Convent(i)on (i)n whole or (i)n part, then, unless the new Convent(i)on otherw(i)se prov(i)des-
- (a) the rat(i)f(i)cat(i)on by a Member of the new rev(i)s(i)ng Convent(i)on shall (i)pso jure (i)nvolve the (i)mmed(i)ate denunc(i)at(i)on of th(i)s Convent(i)on, notw(i)thstand(i)ng the prov(i)s(i)ons of Art(i)cle 21 above, (i)f and when the new rev(i)s(i)ng Convent(i)on shall have come (i)nto force;
- (b) as from the date when the new rev(i)s(i)ng Convent(i)on comes (i)nto force th(i)s Convent(i)on shall cease to be open to rat(i)f(i)cat(i)on by the Members.
2. Th(i)s Convent(i)on shall (i)n any case rema(i)n (i)n force (i)n (i)ts actual form and content for those Members wh(i)ch have rat(i)f(i)ed (i)t but have not rat(i)f(i)ed the rev(i)s(i)ng Convent(i)on.
